1. About these Terms
These Terms and Conditions (the “Terms”) govern your use of the Weebou mobile application (the “App”), the Weebou website (the “Website”) and the content and services offered through them (together, the “Service”).
The Service is provided by Omyteq SAS, a French company registered under SIREN number 942 915 778 (“Omyteq”, “we”, “us”).
By downloading the App or using the Service, you agree to these Terms. Our Privacy Policy, which explains how we handle personal data, also applies. If you do not agree with these Terms, please do not use the Service.
2. Who can use Weebou
Weebou is designed for young children, used with the help and supervision of an adult. The person who downloads the App, creates an account or buys a subscription (the “Parent”) must be an adult and the parent or legal guardian of the children who use it.
As the Parent, you accept these Terms on behalf of your children, you supervise their use of the Service, and you are responsible for the activity on your account and for keeping your device and account details safe.
3. Your licence to use Weebou
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable and revocable licence to install the App on devices you own or control, and to use the Service for your family’s private, non-commercial use. Where your app store offers family sharing, you may share your subscription in line with its rules.
4. Intellectual property
The Service and everything in it, including the Weebou name and logo, the characters Weebou, Luna, Mini, Zig and Nova, illustrations, animations, videos, stories, music, games and software, are owned by Omyteq or its licensors and protected by intellectual property laws.
Apart from the licence described above, no rights are transferred to you. You may not copy, reproduce, distribute, adapt, publicly display or exploit any part of the Service without our prior written permission, except where the law expressly allows it.
5. Acceptable use
When using the Service, you agree not to:
- use it for any commercial purpose or make it available to the public, for example in a school, shop or public place, without our agreement;
- copy, extract or collect its content in bulk, including through bots, scrapers or other automated means;
- decompile, reverse engineer or attempt to access the source code of the App, except where the law allows it;
- bypass or interfere with security features, access restrictions or the subscription system;
- introduce viruses or any harmful code, or disrupt the Service or the servers that run it;
- use the Service in a way that breaks the law or infringes the rights of others.
6. Subscriptions, trials and payments
- Purchases through app stores. Paid features are sold as subscriptions through the Apple App Store or Google Play. Your purchase is processed by Apple or Google and is also governed by their terms. We do not receive or store your payment card details.
- Price. The price, the billing period and what is included are shown before you confirm your purchase, including applicable taxes.
- Automatic renewal. Subscriptions renew automatically for the same period, at the price then in force, unless you cancel at least 24 hours before the end of the current period.
- Free trials. If we offer a free trial, the paid subscription starts automatically at the end of the trial unless you cancel at least 24 hours before it ends. Free trials are limited to one per person or account.
- How to cancel. You can manage or cancel your subscription at any time in your Apple ID or Google Play account settings. Cancellation takes effect at the end of the current paid period, and you keep access until then.
- Price changes. If we change the price of a subscription, you will be informed in advance through your app store or the App, and you can cancel before the new price applies.
7. Refunds and right of withdrawal
Because purchases are made through Apple or Google, refund requests are handled by them under their own refund policies. You can request a refund directly from Apple (reportaproblem.apple.com) or Google Play. If you need help, write to us and we will do our best to assist you.
If you live in the European Union, you normally have 14 days to withdraw from a distance contract. For digital content and services that start immediately, this right ends once access begins, if you have expressly asked for immediate access and acknowledged that you lose your right of withdrawal. This is generally done when you confirm your purchase in the app store. None of this affects your statutory rights if the Service does not conform to what was promised.
8. Changes to the Service
We regularly add, improve and update content, games and features. We may also change or remove parts of the Service, for example for technical, legal or security reasons. If a change significantly reduces what is included in your paid subscription, we will tell you in advance and you may cancel your subscription.
9. Third-party services
The Service may link to services we do not control, such as our YouTube channel, social networks or the app stores. Their own terms and privacy policies apply, and we are not responsible for their content or practices.
10. Availability and legal guarantees
We work hard to keep Weebou available, safe and working well, but we cannot guarantee that it will be uninterrupted or error-free. The Service may be temporarily unavailable, for example during maintenance or because of problems with networks or devices outside our control.
If you are a consumer, you benefit from the legal guarantee of conformity for digital content and services provided by the French Consumer Code (Code de la consommation) and, if you live elsewhere in the EU, by the law of your country. If the Service does not conform, contact us and we will work to fix the problem.
11. Liability
We are responsible for direct damage caused by our failure to comply with these Terms. We are not responsible for damage resulting from misuse of the Service, from failure to follow these Terms, from your devices or internet connection, or from events beyond our reasonable control (force majeure).
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for gross negligence or wilful misconduct, or any rights you have as a consumer that cannot be limited by contract.
12. Suspension and termination
You can stop using the Service at any time and ask us to delete your account. Remember to cancel any subscription in your app store settings as well.
We may suspend or close an account in case of serious or repeated breach of these Terms, fraud or misuse, after informing you where possible. If we close your account without a valid reason related to your conduct, you will not lose any period you have already paid for.
13. Changes to these Terms
We may update these Terms, for example to reflect changes to the Service or to the law. We will update the date at the top of this page and, for significant changes, inform you in the App or by email before they take effect. If you do not agree with the new Terms, you can stop using the Service and cancel your subscription.
14. Disputes and governing law
If something goes wrong, please contact us first at [email protected]. Most problems can be solved quickly this way.
These Terms are governed by French law. If you are a consumer living in another country of the European Union, you also keep the protection of the mandatory rules of the law of your country.
Any dispute will be brought before the competent French courts. As a consumer, you may also bring proceedings before the courts of the place where you live.
15. General provisions
- If any provision of these Terms is found to be invalid, the other provisions remain in force.
- If we do not enforce a provision at a given time, this does not mean we give up our right to enforce it later.
- We may transfer these Terms to another company, for example in the event of a merger or sale, provided this does not reduce your rights.
- These Terms, together with the Privacy Policy, form the entire agreement between you and Omyteq regarding the Service.
- These Terms are written in English. Any translation is provided for convenience.
